MALAYSIAKINI: ANWAR PLEADS NOT GUILTY, RM20000 BAIL

This is surely the beginning of the end for the BN? The first day Anwar claims trial facing new charges of sodomy against Saiful Bukhari Azlan. (As one website put it, Sai-fool)
Anyhow, DSAI pleaded not guilty and the judge, SM Komathy allowed bail of RM 20,000 without any objection by the prosecution. Anwar's pasport was to be surrendered (prosecution's suggestion) and the judge allowed Anwar to bail himself, a personal bond of RM20,000 without any guarantors. However, the judge allowed Anwar to keep his passport, expressing confidence that Anwar was not a flight risk.
The case is set to be mentioned on the 10th of Spetember in the High Court to set a trial date. The charge sheet is as follows:

Bahawa kamu, pada 26 Jun 2008 antara jam 3.01 petang dan 4.30 petang di alamat Unit 11-5-1, Desa Damansara Condominium, No 99 Jalan Setiakasih, Bukit Damansara, dalam Wilayah Persekutuan Kuala Lumpur telah dengan sengaja melakukan persetubuhan yang bertentangan dengan aturan tabii dengan Mohd Saiful Bukhari bin Azlan dengan memasukkan zakar kamu ke dalam duburnya; dan oleh yang demikian kamu telah melakukan satu kesalahan yang boleh dihukum di bawah Seksyen 377B Kanun Keseksaan.Sekiranya disabitkan menurut Seksyen 377B Kanun Keseksaan, kamu hendaklah dihukum dengan penjara selama tempoh yang boleh sampai 20 tahun, dan bolehlah juga dikenakan sebatan.

Yes, yes, it is quite explicit, is it not? Anyhow, Anwar is represented by a team of seven, SEVEN lawyers, led by Sulaiman Abdullah. The lawyers are Sivarasa Rasiah, Sankara Nair, Saiful Izham Ramli, Amir Hamzah, Edmund Bon dan Leela J. Jesuthasan.

Now, Anwar did raise a good point. This charge of sodomy, if consensual, why was not Saiful Bukhari charged as well? Why is Anwar alone charged?

This does make sense, no? I have to say, Saiful Bukhari looks to be a strapping young man. Surely he is more than capable of defending himself from the advances of an elderly man, if the sodomy was forced, right? If the sodomy did actually happen, what was Saiful's reaction while the act happened? If it was consensual, surely Saiful too must be charged for carnal intercourse againt the order of nature. If it was forced, surely Saiful would have left Anwar with more than bruised and blackened eye.
Saiful has been portraying himself as a victim but be realistic. Anwar is an elderly man with a bad back problem. Can he forcefully sodomize a young man built much tougher than him? Anwar even went to a clinic in Munich, Germany for back surgery. Common sense dictates an elderly man of 61 years suffering from a severe back problem cannot possibly force himself onto a young man serving as an aide, much less rip his clothes off, throw him on the bed and forcefully sodomize the young man.

I personally feel that Saiful is indeed Sai-fool. A fool to falsely and foolishly accuse Anwar. In the perfect world, I believing in the rule of law and the impartiality of the judiciary, Anwar would be tried without fear or favor and would be exonarated of all charges, found not guilty and Saiful and his cohorts would be hauled up in court and charged and jailed. (Preferably guillotined)

However, this is Malaysia, so we could really expect what would happen and what verdict would be handed down.

The question now is, would the Judiciary be brave enough to try Anwar without fear or favor, with fairness and impartiality and bowing to no one but the law and justice. Or, will our judiciary, so long the mockery of people, continue to bow down, stamped on and be led on a leash?
Many questions has been raised about the judiciary, many doubts has been expressed and many people have criticized the judiciary's loss of independence. Is the judiciary unfairly targeted or is the judiciary rotten, plain and simple.
I believe that there might be hope, if only someone with a conscience would stand up and do what is right. Edmund Burke once said, "The only thing necessary for the triumph of evil is for good men to do nothing."
I hope that there are still good men and women in the judiciary. Every tale of darkness has a sliver of hope. Hope may not be much but hope is what drives men to continue. Hope for a better nation for all is what drives Anwar, hope for equality for all is what drives me and I sincerely hope that our judiciary has hope as well.

It means, Let Justice Be Done, Though The World Perish.

Let's hope the judiciary has balls.
